Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Ontario Bar Academy (the “Service”), operated by the owner of Ontario Bar Academy (“we,” “us,” or “our”), reachable at support@ontariobaracademy.com. By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Ontario Bar Academy provides original, independently authored practice examinations modelled on the format of the Law Society of Ontario’s Barrister and Solicitor licensing examinations. The Service is an independent educational product. It is not produced, approved, endorsed, administered, or affiliated with the Law Society of Ontario or any other licensing or regulatory body. Questions are original practice questions, not actual Law Society licensing examination questions, and results on the Service are not an official assessment and do not guarantee any result on an official licensing examination.

• You must be at least 18 years old to create an account.
• You agree to provide accurate registration information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us promptly at support@ontariobaracademy.com if you suspect unauthorized use of your account.
• Accounts are personal to you and may not be shared, sold, or transferred.

• Prices for exam products are shown on our pricing page and are in Canadian dollars unless stated otherwise. Prices exclude sales tax. Where we are required to collect GST or HST, it is calculated on your billing address and shown as a separate line at checkout.
• Payments are processed by Stripe, a third-party payment processor. We do not collect or store your full payment card details; see our Privacy Policy for details.
• A purchase grants you a limited number of attempts on the specific exam product(s) purchased, as described on the pricing page at the time of purchase.
• Refunds: A refund is available if requested within 24 hours of purchase, provided no attempt on the purchased exam has been started. Once an exam attempt has begun, the purchase is non-refundable.

All examination questions, model answers, explanations, commentary, and other content made available through the Service (“Content”) are original works owned by us or our licensors and are protected by copyright and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable licence to access and view the Content for your own individual exam preparation. You may not, and agree not to:

• copy, photograph, screenshot, screen-record, print, download, scrape, or otherwise reproduce any Content, in whole or in part;
• share, publish, post, sell, distribute, or otherwise make Content available to any third party, including on tutoring platforms, study groups, forums, or social media;
• use any automated means (bots, scripts, crawlers) to access or extract Content or other data from the Service;
• reverse engineer, decompile, or attempt to derive the source code or underlying question bank of the Service; or
• use the Service or Content to train, fine-tune, or evaluate any artificial intelligence or machine learning model.

We reserve the right to suspend or terminate any account we reasonably believe has violated this section, without refund.

You agree to use the Service only for lawful purposes and in a manner consistent with genuine individual exam preparation. You will not attempt to interfere with the proper functioning of the Service, circumvent any access or security features (including the per-question anti-copying measures described in the Service), or impersonate another person.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Content reflects the current state of the law, that use of the Service will result in success on any official licensing examination, or that the Service will be uninterrupted, secure, or error-free. Scores and performance bands shown on the Service are an internal educational benchmark only and are not an official Law Society of Ontario pass standard.

The Service does not provide legal advice, and nothing on the Service should be relied upon as legal advice for any actual client matter.

To the fullest extent permitted by law, Ontario Bar Academy and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from or related to your use of the Service. Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the Service and close your account at any time by contacting us at support@ontariobaracademy.com.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these Terms or the Service.
